Scope and acceptance of these terms

These Terms of Sale govern all purchases of fine art prints and related products made through the online shop at atkye.africa-photography.ch (the "Shop").


By placing an order, you confirm that you have read, understood and accepted these Terms of Sale, together with our Privacy Policy and Cookie Policy.


The Shop is dedicated exclusively to the sale of physical fine art prints; no digital products are offered. A portion of the purchase price is donated to Associazione


Ticino Kenya Youth Education (ATKYE) in support of education projects in Kenya. Further information about ATKYE is available on the dedicated ATKYE page.


These Terms of Sale apply to all buyers using the Shop, regardless of their country of residence, unless mandatory local consumer protection rules provide otherwise. If you do not agree with these Terms of Sale, you should not submit an order.

Key terms used in this document

For the purposes of these Terms of Sale:

  • "We", "us" or the "Seller" means the operator of the Shop and the legal entity identified in the Imprint.
  • "You" or the "Buyer" means any person or entity placing an order through the Shop.
  • "Products" means the physical fine art prints and related items offered for sale in the Shop.
  • "Custom order" means a product that is produced specifically according to your individual choices (for example, a print ordered from the Portfolio Selection or based on a specific image from the online portfolio).
  • "Working day" means a day other than Saturday, Sunday or a public holiday in the Seller’s place of business.
How an order becomes binding

The presentation of Products in the Shop is a non-binding invitation to place an order and does not constitute a legally binding offer.

By completing the online checkout process and clicking the button to confirm your order, you submit a binding offer to purchase the selected Products. Before submitting the order, you can review and, if necessary, correct the information you have provided.

After submitting your order, you will receive an automatic email confirming receipt of the order. This confirmation does not yet constitute acceptance of your offer. The sales contract is concluded only when we explicitly accept your order by separate email (order confirmation) or when we ship the Products, whichever occurs first.

We reserve the right to refuse or cancel orders for justified reasons, in particular in cases of typographical errors, obvious mistakes in pricing, stock unavailability, suspected fraud or abuse, or where we have reasonable grounds to believe that the Buyer is purchasing for resale without our prior consent.

Information about ordering, editions and certificates is further detailed on the Editions & Certificates and FAQ pages, which are for information only and do not override these Terms of Sale.

How prices are shown and what is included

All prices displayed in the Shop are indicated in the currency stated on the product and checkout pages. Unless expressly stated otherwise on the checkout page, prices refer to the Product only and do not include shipping costs, customs duties, import taxes or other charges that may apply.

Shipping costs are shown separately during the checkout process before you submit your order and are also described in more detail on the Shipping & Handling page.

Depending on your delivery address, additional customs duties, import VAT or local taxes may be charged by the relevant authorities upon import of the Products. These charges are your responsibility and are not collected by us. Please check with your local customs office for details before ordering.

We may change prices at any time without prior notice. For orders already submitted, the price applicable is the one displayed at the time you placed your order.

Payment methods and security

We accept the payment methods shown during the checkout process (for example credit or debit cards, bank transfer, or other online payment services). We may change the available payment methods at any time.

Payment is due immediately upon conclusion of the contract, unless another payment term is explicitly indicated. For orders paid by bank transfer, we may wait for receipt of funds before starting production and shipping of the Products.

Payments are processed through third-party payment providers that use appropriate technical and organisational measures to protect your data. Further information about how your payment data is processed is available in our Privacy Policy and in the information provided by the relevant payment provider.

In case of payment default, we are entitled to cancel the order or to claim statutory default interest and reasonable collection costs, where permitted by applicable law.

Packaging, delivery times and transfer of risk

Fine art prints are carefully packaged to protect them during transport. Further details on packaging, shipping options, indicative delivery times and insurance are provided on the Shipping & Handling page.

Estimated delivery times shown in the Shop or in emails are indicative only and are not guaranteed, as actual delivery may depend on production schedules, carrier performance and customs procedures. We will inform you of any significant delays where reasonably possible.

The risk of accidental loss or damage to the Products passes to you when the Products are handed over to the carrier. If you are a consumer and your order is shipped to a country where mandatory consumer protection rules provide otherwise, the transfer of risk will follow those mandatory rules.

Upon delivery, please inspect the package and Products as soon as reasonably possible. If you notice visible damage to the packaging or the Products, you should document it (for example with photographs), report it to the carrier upon delivery where possible, and contact us promptly in accordance with the procedure described on the Tracking, Insurance & Damages section.

Your cancellation rights and exclusions

If you are a consumer residing in a country that grants a statutory right of withdrawal for distance contracts, you may have the right to withdraw from the sales contract within the period and under the conditions provided by the mandatory law of your country. Nothing in these Terms of Sale is intended to limit such mandatory rights.

In general, and subject to applicable mandatory law, the right of withdrawal does not apply to custom orders or Products that are clearly personalised according to your specifications (for example, prints produced on demand from the Portfolio Selection or based on a specific image requested by you), unless we agree otherwise in writing.

If you wish to exercise your right of withdrawal (where available) or request a return, you must notify us in writing within the applicable time limit, using the contact details provided on the Contact page. We may ask you to provide proof of purchase and photographs if the reason for return is a defect or transport damage.

Returned Products must be sent back in their original or equivalent protective packaging and in an unused, undamaged condition, unless the return concerns a defect. Unless otherwise required by mandatory law, you bear the direct cost of returning the Products to us.

Defects, complaints and limitation of liability

If a Product is defective, damaged or does not correspond to your order, please contact us without undue delay after discovery of the issue, using the contact details indicated on the Contact page. Please provide your order number, a description of the problem and, where possible, photographs documenting the defect or damage.

Where a defect is established in accordance with applicable law, we will, at our choice and where legally permitted, repair the defect, replace the Product with an equivalent item, or refund the purchase price (including, where required by law, reasonable shipping costs).

Our liability for slight negligence is excluded to the fullest extent permitted by applicable law. In any event, and except in cases of intent, gross negligence, personal injury, mandatory product liability or other cases where limitation of liability is not allowed by law, our aggregate liability arising out of or in connection with a contract of sale is limited to the amount you actually paid for the Product concerned.

Nothing in these Terms of Sale affects your mandatory statutory rights as a consumer, where such rights apply.

How your purchase supports education projects

A portion of the proceeds from the sale of Products in this Shop is donated to Associazione Ticino Kenya Youth Education (ATKYE) to support education projects in Kenya. The indicative donation model and examples of supported initiatives are described on the ATKYE page.


Unless explicitly stated otherwise on the product or checkout page, the purchase price you pay is not a tax-deductible donation for you but a payment for the Product.


Any donation to ATKYE is made by the Seller and is accounted for separately. This arrangement does not affect your rights under the sales contract.

We aim to act with transparency and care in how we support ATKYE.

How we handle your personal data

We process your personal data in connection with your order for the purposes of handling your purchase, communicating with you, fulfilling legal obligations and, where applicable, for customer service and accounting purposes.

Detailed information about the types of data we collect, the purposes and legal bases of processing, data sharing, retention periods and your rights is provided in our Privacy Policy. The use of cookies and similar technologies is described in our Cookie Policy.

By placing an order, you acknowledge that you have read the Privacy Policy and Cookie Policy and that you understand how your data is used in connection with your purchase.

Applicable law and competent courts

Unless mandatory consumer protection rules of your country of residence provide otherwise, these Terms of Sale and all contracts of sale concluded through the Shop are governed by the law specified in the Imprint, to the exclusion of its conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods (CISG).

Subject to mandatory consumer jurisdiction rules, any dispute arising out of or in connection with these Terms of Sale or a contract of sale shall be submitted to the competent courts indicated in the Imprint. If you are a consumer, you may also bring proceedings before the courts of your place of residence, where this is required by applicable mandatory law.

Changes to these terms and other provisions

We may amend these Terms of Sale from time to time, for example to reflect changes in our services, legal requirements or market conditions. The version applicable to a specific order is the one in force at the time you placed your order, as displayed in the Shop at that moment.

If any provision of these Terms of Sale is or becomes invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision will be replaced, where permitted by law, by a valid provision that comes closest to the economic intent of the original provision.

These Terms of Sale are provided in English. If we offer translations into other languages, the English version shall prevail in case of any inconsistencies, unless mandatory law in your country of residence provides otherwise.
